1. Introduction

These Terms of Service govern the use of Ibda_Whats (“the Application”, “we”, “our”, or “us”), including its integration with the WhatsApp Business Messaging API.

By using the Application, you agree to these Terms. If you do not agree, please do not use the Application.

2. Purpose of the Application

The Application provides WhatsApp messaging functionality for sending and, where supported, receiving messages, notifications, and other communications.

Access to and use of these services may depend on the configuration of the Application and the availability of third-party services.

3. Acceptable Use

You agree to use the Application lawfully and responsibly. You must not:

  • Use the Application to send spam, fraudulent messages, threats, or unlawful content.
  • Send messages to recipients without the necessary consent or other lawful basis.
  • Violate the privacy, rights, or applicable laws of others.
  • Attempt to compromise, disrupt, or gain unauthorized access to the Application or its associated systems.
  • Use the Application in a manner that violates Meta’s or WhatsApp’s applicable terms, policies, or messaging requirements.

You are responsible for ensuring that your use of the Application complies with applicable data protection and electronic communications laws.

4. WhatsApp and Third-Party Services

The Application may rely on Meta’s WhatsApp Business Platform and other third-party services.

Your use of WhatsApp messaging is subject to the applicable Meta and WhatsApp terms and policies. We do not control the availability, functionality, or decisions of third-party providers.

Third-party service interruptions, policy changes, or account restrictions may affect the availability of messaging functionality.

5. Privacy and Personal Data

6. Availability and Changes

We aim to keep the Application operational but do not guarantee uninterrupted or error-free service.

We may update, modify, suspend, or discontinue features where reasonably necessary, including for maintenance, security, legal compliance, or changes to third-party services.

7. Limitation of Liability

To the extent permitted by applicable law, we are not responsible for losses resulting from third-party service outages, message delivery failures, unauthorized use caused by your failure to secure your account, or use of the Application contrary to these Terms.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

8. Suspension or Termination

We may suspend or terminate access to the Application where necessary to address misuse, security risks, legal requirements, or violations of these Terms or applicable third-party policies.

You may stop using the Application at any time.

9. Changes to These Terms

We may revise these Terms from time to time. Updated Terms will be published at the URL where this document is hosted. The effective date will be updated when material changes are made.

10. Governing Law

These Terms are governed by the laws applicable in the jurisdiction in which the Application operator is established, subject to any mandatory consumer protection laws that apply.
